By accessing or using the MVP Rad website (mvprad.com) or any MVP Rad software products, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
MVP Rad products are workflow productivity and documentation automation tools for radiology professionals. The software generates template text that assists radiologists with report drafting. It is provided "as-is" and "as-available" without warranty of any kind, express or implied.
MVP Rad products are NOT medical devices. They do not analyze, interpret, or process medical images. They do not provide diagnostic conclusions, clinical recommendations, or treatment guidance. They are documentation tools only.
All clinical decisions and final report content are the sole responsibility of the licensed interpreting physician. The radiologist must review, verify, edit, and approve all output generated by MVP Rad software before use in any clinical context. Use of MVP Rad does not replace, reduce, or substitute for the professional judgment of a licensed clinician.
MVP Rad software is designed with HIPAA compliance considerations in mind. PHI is processed locally on your machine and is never transmitted to our servers. However, you are solely responsible for HIPAA compliance in your own environment, including workstation security, access controls, and proper handling of patient data. We are not a Business Associate under HIPAA unless a separate Business Associate Agreement has been executed.
MVP Rad products are offered on a monthly subscription basis. Subscriptions renew automatically each month unless cancelled. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. Prices are subject to change with 30 days' notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICHAEL VON PLATO, M.D. RADIOLOGY SERVICES, PC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF MVP RAD SOFTWARE OR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
All MVP Rad software, website content, trademarks, and associated intellectual property are owned by Michael von Plato, M.D. Radiology Services, PC. Your subscription grants you a limited, non-exclusive, non-transferable license to use the software for its intended purpose. You may not reverse engineer, decompile, distribute, sublicense, or create derivative works from the software.
We reserve the right to suspend or terminate your access to the software at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your license to use the software is immediately revoked.
These Terms of Service are governed by and construed in accordance with the laws of the State of [STATE], without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of [STATE].
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the software after changes constitutes acceptance of the revised terms.
